1. Operator and contact

The Service is operated by the owner of PairDare (https://pairdare.com).

2. Eligibility (18+)

You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) to use the Service.

By using the Service, you represent that you meet this requirement and that you will not allow minors to access adult content on the Service.

3. Description of the Service

PairDare provides digital entertainment for consenting adult couples, including truth-or-dare style games, themed challenge decks, and related features. Some content is free; additional content requires Premium.

The Service is provided for private, non-commercial use between you and your partner. We may add, change, or remove features during active development.

4. Account registration and security

You may need an account for Premium and certain features. You agree to provide accurate information and keep your credentials confidential.

You are responsible for all activity under your account. Notify us immediately if you suspect unauthorized access.

We may suspend or terminate accounts that violate these Terms or applicable law.

5. Premium subscription and payments

Premium grants access to digital content and features for a limited period as displayed at checkout.

Payments are processed by Heleket using cryptocurrency or other methods they support. We do not store your wallet keys or full payment credentials.

Prices, duration, and available payment methods are shown before payment. Taxes may apply depending on your location.

During the active development period, Premium expiry may not begin until the date shown on the Premium page — this does not reduce your purchased access period once billing starts.

6. Refunds and chargebacks

Premium is a digital service delivered immediately upon activation. Except where mandatory consumer law requires otherwise, all sales are final and non-refundable once Premium access is granted.

If a payment error or duplicate charge occurs, contact us at the email above within 14 days with your order details. Cryptocurrency transactions may be irreversible; we will assist in good faith where technically possible.

Abusive chargebacks or payment disputes made in bad faith may result in account termination.

7. Acceptable use

You agree not to:

• Use the Service if you are under 18 or allow minors to access it.
• Use challenges to harm, coerce, or harass any person without their informed consent.
• Reverse engineer, scrape, bulk-download, or resell content from the Service.
• Attempt to bypass Premium, security, or access controls.
• Upload malware, spam, or unlawful content through any feature.
• Use the Service for commercial purposes without our written permission.

8. Adult content and personal responsibility

The Service contains sexually suggestive and adult-themed material intended for mature couples. All activities suggested by cards are voluntary; you and your partner must communicate boundaries and consent.

We are not responsible for how you choose to interpret or perform challenges. Stop any activity that feels unsafe or uncomfortable.

9. Intellectual property

All software, design, text, images, and game content on the Service are owned by us or our licensors and protected by copyright and other laws.

We grant you a limited, personal, non-transferable, revocable license to use the Service for its intended purpose. You may not copy, modify, or distribute our content except as allowed by law.

10. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

We do not guarantee uninterrupted or error-free operation, especially during active development.

11. Limitation of liability

To the maximum extent permitted by law, we shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from your use of the Service.

Our total liability for any claim relating to the Service shall not exceed the amount you paid us in the 12 months before the claim, or USD 50 if you paid nothing.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the minimum permitted by law.

12. Termination

You may stop using the Service at any time. You may request account deletion by contacting us.

We may suspend or terminate access if you breach these Terms, if required by law, or to protect the Service and other users.

Sections that by nature should survive (intellectual property, disclaimers, liability limits, governing law) survive termination.

13. Changes to the Terms

We may update these Terms. The 'Last updated' date will change. Material changes will be posted on the Service; continued use after notice may constitute acceptance where permitted by law.

14. Governing law and disputes

These Terms are governed by the laws applicable at the Operator's place of establishment, without regard to conflict-of-law rules, unless mandatory consumer protection laws in your country require otherwise.

Disputes should first be addressed by contacting us. Where permitted, courts at the Operator's place of establishment shall have jurisdiction, without prejudice to your statutory rights as a consumer in the EU/EEA, UK, or other jurisdictions.

15. Consumer rights (EU/EEA and other regions)

If you are a consumer in the EU/EEA, UK, or another jurisdiction with mandatory consumer protections, nothing in these Terms limits your non-waivable statutory rights, including rights regarding digital content conformity and unfair terms where applicable.

For digital content not supplied on a tangible medium, you may lose the right of withdrawal once performance begins with your prior express consent, as allowed by applicable law.
